Terms and Conditions

Effective: 8 October 2026

The Hungarian and English versions of these Terms have the same content. For business Customers, the Hungarian version prevails in case of any discrepancy.

These Terms and Conditions (the "Terms") govern the use of the Estamotion service. Please read them carefully before ordering, in particular Section 7 (responsibility for the materials supplied), Section 8 (nature of AI-generated content), Section 11 (liability) and Section 13.3 (jurisdiction). These provisions must also be accepted separately and expressly when ordering (Section 4.5).

1. Service provider

  • Name: Boros Márk, sole proprietor (egyéni vállalkozó)
  • Registered and postal address: 1112 Budapest, Gazdagréti út 20., ground floor, door 1, Hungary
  • Registration number: 62358477
  • Tax number: 92083361-1-43
  • Email: hello@estamotion.hu
  • Website: estamotion.hu
  • Hosting provider: see the Legal notice

The Provider is covered by the Hungarian subjective VAT exemption (alanyi adómentesség); no VAT is shown on invoices.

2. Definitions

  • Service: creating a captioned property video with camera motion from photos and details supplied by the Customer, using artificial intelligence (AI).
  • Customer: the person or entity ordering the Service. A consumer is a natural person acting for purposes outside their trade, business or profession; every other Customer is a business.
  • Materials: all photos, videos, texts, logos, names, trademarks, music, floor plans, data and other content supplied by the Customer for the order.
  • Video: the video file delivered as the result of the Service (landscape 16:9 and portrait 9:16 versions).

3. Scope of the Service

The Provider creates each video from up to 12 photos. For every photo it creates a camera movement using AI models, edits the scenes together and, as ordered, adds captions, info cards, music, a logo and, on request, a voice-over. The Video is delivered in MP4 format at [TO BE COMPLETED: e.g. 1080p] resolution, plays on common devices and platforms, and is not restricted by any technical protection measure. The exact scope is set by the description published on the website and by the order. For other requirements (more photos, a longer video, a custom format) the Provider gives an individual quote.

4. Orders and conclusion of the contract

4.1. Orders can be placed in the estamotion.hu application or by email to hello@estamotion.hu. In the application, the steps are: (1) sign up or log in; (2) upload the photos and enter the video details; (3) check and correct the details on the summary page; (4) make the declarations under Section 4.5; (5) press the "Order with obligation to pay" button and pay; (6) confirmation.

4.2. The Provider confirms receipt of the order by email without delay. The contract is concluded when the Provider accepts the order (by email or in the application). If acceptance does not arrive within 48 hours of sending the order, the Customer is released from the order, and the Provider refunds any fee already paid within 8 days. The contract is a written contract concluded electronically; the Provider keeps the confirmation and the accepted version of the Terms electronically and makes them available on request. The language of the contract is the language of the interface used to order (Hungarian or English). The Provider has not subscribed to any code of conduct.

4.3. Before submitting the order, the Customer may correct input errors at any time on the summary page or with the "Back" button, and may request corrections by email afterwards.

4.4. The Hungarian and English versions of these Terms have the same content; for business Customers, the Hungarian version prevails in case of discrepancy.

4.5. To place an order, the Customer must make separate declarations using checkboxes that are not pre-ticked: confirming its rights under Section 7.1, and expressly accepting Sections 7.2–7.3, 8 and 11 and, for businesses, Section 13.3; consumers must also make the declaration under Section 12.2. The Provider accepts an order sent by email only if the Customer has made the same declarations by email, using the text sent by the Provider. The Provider keeps the declarations (time, version of the Terms, identification data) as evidence and repeats them in the confirmation email.

4.6. The Provider may decline an order before accepting it without giving reasons; in that case it refunds any fee already paid within 8 days.

5. Prices and payment

5.1. Prices are shown on the website (in HUF on the Hungarian site and in EUR on the English site). Prices are final; no tax or other charge is added. The price published at the time of the order applies.

5.2. The first video can be ordered at a reduced price. The discount can be used once per Customer, or once per business.

5.3. Fees are payable in advance by bank card via Stripe. Work starts once payment has been received. The Provider issues an electronic invoice, which the Customer agrees to accept.

5.4. Videos purchased in a pack have no expiry date. A pack is governed by the version of the Terms in force at the time of purchase.

6. Delivery and deadline

6.1. The Provider delivers the Video by email, as a download, within 12 hours of receiving the complete order (all required Materials, details and declarations) and the payment. If anything is missing from the order, the Provider will say so, and the deadline starts when the missing item is supplied.

6.2. The deadline does not include any period during which delivery is prevented by causes beyond the Provider's control (for example an outage of the AI or hosting services used, a power cut or force majeure).

6.3. The 12-hour deadline is a target time. If, for reasons attributable to the Provider, the Video is delivered after the deadline in Section 6.1 and the Customer complains about the delay, the Provider will refund or credit 10% of the fee of that order. To the fullest extent permitted by law, further claims for the delay (for example damages) are excluded for business Customers; this Section does not affect the statutory rights of consumer Customers.

7. Materials supplied by the Customer; Customer's warranties and responsibility

7.1. The Customer represents and warrants that, for all Materials it supplies, it holds every right and consent needed for the Provider to use and adapt them and incorporate them into the Video, for the Customer to publish the Video and, if the Customer has agreed to it, for the Provider to show the Video as a reference under Section 10.4. This includes in particular:

  • permission from the authors of the photos and other works (for example the property photographer) to reproduce the work, adapt and modify it using artificial intelligence, incorporate it into the Video, communicate it to the public, use it without naming the author, and for the Provider to pass the photos to its contractors named in the Privacy policy (for example AI providers) for processing;
  • the consent of the owner or holder of the property, if the Customer is not the owner;
  • the consent of any identifiable person whose image or voice appears in the Materials, and informing those persons about the processing of their data;
  • the right to use any logos, names and trademarks;
  • the accuracy of the details supplied (price, floor area, number of rooms, address, view, etc.).

7.2. By placing the order, the Customer grants the Provider – in its own right or under the rightholder's permission – a non-exclusive, royalty-free licence to use the Materials as described in Section 7.1, to the extent and for the period needed to perform the contract (and, if consent is given under Section 10.4, to show the Video as a reference), including the right to sublicense to the Provider's contractors. The Provider may rely on the Customer's declaration under Section 7.1; it does not examine the legal status of the Materials and has no obligation to do so. If a Material shows an obvious sign of infringement (for example a third-party watermark or a photographer's or portal's mark), the Provider may proceed under Section 7.5. The Provider does not remove watermarks, copyright notices or rights management information.

7.3. As between the parties, the Customer is responsible for the lawfulness of the Materials. If a third party (for example an author, photographer, owner, person depicted or trademark holder) or an authority brings a claim against the Provider alleging that the Materials, the parts of the Video based on them, or the Customer's publication of the Video infringe their rights or the law, the Customer shall indemnify and hold the Provider harmless and reimburse the Provider's documented losses and costs, including damages, compensation for non-pecuniary harm, disgorgement of profits, court costs, reasonable legal fees and, to the extent permitted by law, fines imposed on the Provider. This does not apply where the claim arises from an element supplied by the Provider (such as music or templates) or from the Provider's own fault. The Provider will notify the Customer without delay, allow the Customer to take part in the defence, and will not admit or settle the claim without the Customer's consent unless the Customer fails to cooperate. This Section survives termination of the contract.

7.4. Materials that are unlawful, infringe the rights of others, or are misleading, violent, hateful, sexual or harmful to minors must not be supplied.

7.5. If the Provider has good reason to believe that using any Material would breach the law or the rights of others, it may refuse or suspend the order and delete the Material concerned. If work has not yet started, the Provider refunds the full fee; if work has started and the refusal results from the Customer's breach of Section 7.1 or 7.4, the Provider may retain the part of the fee corresponding to the work done.

7.6. Before performance, or when a claim arises, the Provider may ask the Customer to prove its rights under Section 7.1 within 5 business days (for example with the photographer's licence or the owner's consent). If no proof is provided, Section 7.5 applies.

7.7. Reporting infringements. Anyone who believes that Material or a Video stored, processed or shown as a reference by the Provider infringes their rights (in particular copyright or image rights) may report this to hello@estamotion.hu (point of contact; languages: Hungarian, English). The notice must include the reporter's name and contact details, identification of the content, the right concerned with reasons, and a statement that the notice is made in good faith. Within 2 business days of a substantiated notice, the Provider disables access to or deletes the content on its own channels, informs the Customer of its decision with reasons, and leaves the dispute to be settled between the reporter and the Customer. The Customer is responsible for removing any Video it has already published.

8. Nature of AI-generated content; the Customer's duty to review

8.1. The camera movements in the Video are generated by artificial intelligence. The AI may fill in details not visible in the photos, and scenes may contain minor deviations, distortions or inaccuracies (for example in perspective, objects or lighting). The Provider selects scenes carefully but does not warrant that the Video matches reality in every detail. The Customer expressly acknowledges and accepts this when ordering.

8.2. The Video is an illustration and does not constitute a statement or expert opinion on the property's condition, size or features.

8.3. The Customer must watch and review the Video before publishing it. The Customer alone decides on publication and is responsible for ensuring that the Video and the related advertisement comply with the law (in particular the rules on unfair commercial practices and advertising) and with the rules of the platforms where it is published (property portals, social media, booking sites).

8.4. In line with Article 50 of Regulation (EU) 2024/1689 (the AI Act), the Provider labels the Video as AI-generated content with a visible, discreet caption (for example "Created with AI assistance") and in the file metadata. At the Customer's request the Provider may change the form and position of the label but will not omit it. The Customer must not remove or cover the label and, when publishing, must make the AI-generated nature of the scenes clear to viewers; the Customer is responsible for any breach of this obligation. The same applies to AI-generated voice-overs.

9. Changes and statutory warranty

9.1. Within 7 days of delivery, the Customer may request changes free of charge within the original scope of the order (for example caption text, scene order, music, or regenerating individual scenes). New photos or a substantially different concept count as a new order.

9.2. If the Video does not match the order, the Customer may report the defect by email. The Provider will primarily correct the defect or recreate the Video; if this is not possible, it will refund the fee in part or in full. In case of a defect, consumers may – at their choice – request correction or recreation or, if that is impossible or disproportionate, a price reduction or termination; the defect must be reported without delay after discovery, and the claim expires 2 years after delivery (statutory warranty of conformity under Sections 6:159–6:163 of the Hungarian Civil Code and Government Decree 373/2021 (VI. 30.)). Minor deviations arising from the nature of AI under Section 8.1 do not constitute a defect.

10. Rights to use the Video

10.1. Upon full payment, the Customer obtains a non-exclusive licence, unlimited in time and territory, to use the Video for its own purposes (advertising, its own website, social media, property and holiday rental portals, informing clients) and to pass it on to third parties for these purposes. The Provider retains all rights in the templates, methods and know-how used to create the Video.

10.2. The music in the Video is licensed for use together with the Video and may not be used separately. Copyright filtering systems on some platforms (for example Content ID) may flag licensed music; in such cases the Provider will help verify the licence or, on request, replace the music.

10.3. Copyright protection of AI-generated content varies between legal systems; the Provider does not warrant that every part of the Video is protected by copyright.

10.4. The Provider may show the Video (or parts of it) as a reference on its website, on social media and in its offers only if the Customer has expressly agreed to this when ordering or later; by agreeing, the Customer warrants that its rights under Section 7.1 cover this use. Consent may be withdrawn at any time; upon withdrawal or a notice of infringement, the Provider removes the reference within 3 business days.

11. Liability

11.1. Towards Customers who are businesses, the Provider's liability for damage caused by breach of contract is limited to the fee of the order concerned, and the Provider is not liable for loss of profit, lost bookings or deals, advertising costs, or for a platform rejecting or removing the Video. Towards consumers, the Provider is liable in accordance with the law.

11.2. The Provider is not liable for damage resulting from the Customer's breach of Section 7.1 or 7.4, or from the Customer publishing the Video without the review required by Section 8.3 or in breach of the law.

11.3. The limitations of liability in these Terms do not apply to damage caused intentionally or by gross negligence, or to breaches causing harm to human life, physical integrity or health (Section 6:152 of the Hungarian Civil Code).

12. Consumers' right of withdrawal

12.1. Under Hungarian Government Decree 45/2014 (II. 26.), consumers may withdraw from the contract within 14 days of its conclusion without giving reasons.

12.2. As the Video is completed within 12 hours of the order, when ordering the consumer expressly requests, using a separate checkbox, that the Provider start performance before the withdrawal period expires, and acknowledges that the right of withdrawal is lost once the Video is delivered (the service is fully performed). If the consumer withdraws after performance has started but before delivery, they must pay a fee proportionate to the service already performed. The Provider confirms this declaration in the confirmation email.

12.3. Consumers may exercise the right of withdrawal by an unequivocal statement sent by email to hello@estamotion.hu or by post to the Provider's registered address; the following model may be used (its use is optional). The deadline is met if the statement is sent before the withdrawal period expires.

To: Boros Márk e.v., 1112 Budapest, Gazdagréti út 20., ground floor, door 1, Hungary, hello@estamotion.hu
I/We hereby give notice that I/We withdraw from my/our contract for the provision of the following service: …
Ordered on: …
Name of consumer(s): …
Address of consumer(s): …
Signature of consumer(s) (only if this form is notified on paper): …
Date: …

12.4. In the event of withdrawal, the Provider will refund the amount paid by the consumer (less the proportionate fee under Section 12.2) within 14 days of learning of the withdrawal, using the same payment method unless the consumer expressly agrees otherwise; this incurs no additional fee.

13. Complaints and disputes

13.1. Complaints can be sent to hello@estamotion.hu or by post to the registered address. The Provider will reply to written complaints in substance and in writing within 30 days, giving reasons if the complaint is rejected. When rejecting a consumer's complaint, the Provider will say which authority or conciliation body the consumer can turn to. The Provider keeps complaints and replies for 3 years.

13.2. In a consumer dispute, the consumer may turn to the conciliation body competent for their place of residence. The body competent for the Provider's seat is the Budapest Conciliation Board (Budapesti Békéltető Testület), 1016 Budapest, Krisztina krt. 99., phone: +36 1 488 2131, email: bekelteto.testulet@bkik.hu, bekeltet.bkik.hu. Consumers may also file a consumer protection complaint with the government office competent for their place of residence. Consumers resident in another EU country may also contact the European Consumer Centre in their country.

13.3. Hungarian law governs the contract. For consumers, this choice does not deprive them of the protection of the mandatory provisions of the law of their country of habitual residence. For business Customers, the parties submit to the jurisdiction of the Hungarian courts and the exclusive venue of the court competent for the Provider's seat.

14. Data protection and data processing

14.1. The processing of the Customer's personal data is described in the Privacy policy.

14.2. Where the Materials contain personal data of third parties, the Customer is the controller of such data and the Provider acts as processor under Article 28 GDPR. The subject matter and purpose of the processing is creating and delivering the Video; its duration is the performance and the following 30 days (90 days for the finished Video); the data concerned: image, voice, name, licence plate, address and other data contained in the Materials; the data subjects: natural persons appearing in the Materials. The Provider:

  • a) processes the data only on the Customer's documented instructions set out in these Terms and the order, including with regard to transfers to third countries, and informs the Customer immediately if, in its opinion, an instruction infringes the law;
  • b) ensures that persons with access are bound by confidentiality;
  • c) applies the security measures required by Article 32 GDPR;
  • d) uses as sub-processors those named in the Privacy policy, for which the Customer gives general authorisation; informs the Customer by email in advance of any intended change, to which the Customer may object within 14 days, in which case either party may terminate; and imposes the same obligations on its sub-processors;
  • e) assists the Customer in responding to data subject requests and in meeting its obligations under Articles 32–36 GDPR;
  • f) notifies the Customer of any personal data breach without undue delay;
  • g) deletes the data at the end of the period above, unless the law requires it to be kept;
  • h) makes available the information needed to demonstrate compliance and allows audits agreed in advance.

The Customer is responsible for the legal basis for supplying the data and for informing the data subjects.

15. Final provisions

15.1. The Provider may amend these Terms; it publishes amendments at least 15 days before they take effect and notifies Customers with an account by email. Amendments apply to orders placed after they take effect. A prepaid pack is governed by the Terms in force at the time of purchase; if the Customer does not accept an amendment, the Provider refunds the fee for unused videos.

15.2. If any provision of these Terms is invalid, the validity of the remaining provisions is not affected.

15.3. Matters not regulated in these Terms are governed by the Hungarian Civil Code, Act CVIII of 2001 on electronic commerce services, and Government Decree 45/2014 (II. 26.). The Provider keeps previous versions of these Terms.
